Kya Aap Paanchvi Pass Se Tez Hai? is a
studio-based game show in which succeeding contestants compete
for a large sum of money by attempting to answer questions taken
from primary school class materials. The format outlined below
is how the show works.
Game Play Each round is played by an
individual contestant, who is presented with the chance to win
up to Rs 5 crores by answering 11 questions taken from class
materials (e.g. textbooks or workbooks) of first to fifth class.
The contestant is presented with 10 subject cards, which he may
answer in the order of his choice. Each correct answer moves the
contestant higher up the ladder of rupee value. If a contestant
answers all 10 questions correctly, he is given a chance to
answer an 11th question for Rs 5 crores.
Each time a question is answered, the contestant must "lock in"
the answer by saying it out loud and pressing a buzzer.
As each new question is read, the contestant is given the option
to drop out with the amount of money currently in his bank. If
the contestant chooses to answer the question, but gives the
wrong answer, he walks away with nothing (during questions 1-5)
or with Rs. 2, 00,000 (value of question 5).
The above mechanism varies on the 11th question, if the
contestant should reach it. The 11th question is drawn from a
separate pool of class five questions. Unlike previous
questions, the contestant must commit to answering or walking
away based on the subject alone. He or she will not be allowed
to hear the question before making this decision.
The contestant also has three lifelines called cheats to use
over the course of a round. All these cheats involve his
classmates, which is a group of children seated on stage who are
answering the same questions as the contestant. Every two
questions, a new classmate joins the contestant and becomes his
teammate for those two questions. The contestant can use his
cheats at any time during the first 10 questions.
Cheats The first cheat is called Taak
Jhaak, which means that the contestant has the opportunity
to review his current teammate's answer before submitting his
own.
The second cheat is Copy, in which the contestant may opt
not to answer the question at all, but rather, let his current
teammate answer for him. Unlike the "copy your classmate" cheat,
in this instance, the contestant cannot reject his teammate's
answer, but is stuck with it.
The final cheat is Bachao. This cheat is triggered
automatically if the contestant gives a wrong answer. If the
contestant's current partner turns out to have the correct
answer, the contestant is then saved.
The only instance in which two cheats can be used on the same
question is if the contestant chooses Taak Jhaak, rejects
the kid's correct answer, gives a wrong answer himself, and is
then saved by the kid. Other than this one scenario, the cheats
must necessarily be used individually.
Once all three cheats have been used, the kids will stay in the
"class" and no longer join the contestant at the podium.
If the contestant makes it to the 11th and final question, he
must tackle that question without help, even if he has not used
his cheats.
International Performance The format was
originally created in the U.S and has been adapted in several
countries worldwide.
"KYA AAP PAANCHVI PASS SE TEZ HAI? RULES
AND REGULATIONS FOR THE PROMOTIONAL ACTIVITY TO BE CONDUCTED IN
KANPUR"
"Kya Aap Paanchvi Pass Se Tez Hai? Promotional Activity will be
conducted in Kanpur" ("Activity") which will be in relation to
the program titled "Kya Aap Paanchvi Pass Se Tez Hai?"
(Program), as more particularly stated hereunder:
1. This Activity will be conducted by STAR India Pvt Ltd (STAR
India) during the India - South Africa Test Match ("Match")
which is to be played at the Green Park Stadium ("Stadium") in
Kanpur on April 12, 2008.
2. The Activity will be conducted between 08:00:00 hours to
23:59:59 hours on April 12, 2008 ("Period").
3. On the day of the Match the promoters of the Program will
distribute the t-shirts of "Kya Aap Paanchvi Pass Se Tez Hai?"
outside the Stadium and also within the stands of the Stadium
("T-shirt(s)").
4. During the Period the interested viewer(s) should wear the
T-shirts throughout the Match and also hold placards with a
message written by them relating to the Program.
5. Any viewer who will be captured in the camera/slides at the
Stadium wearing the T-shirt during the Match and who also held
the placard with a message relating to the Program will be
selected for the Activity ("Participant(s)").
6. Out of all the Participant(s) during the Match, STAR India
will randomly select twenty (20) Participants ("Short-listed
Participant(s)") who would have worn the T-Shirt and had written
the most interesting message(s) on the placards in relation to
the Program.
7. The promoters of the Program who will be standing at the
stands inside the Stadium will note the details of the
Short-listed Participant(s) viz. name, address, telephone
number, etc.
8. All the Short-listed Participant(s) should state all the
required information correctly, which have been asked from them.
9. The Short- listed Participant(s) shall be required to take "Kya
Aap Paanchvi Pass Se Tez Hai?" test ("Test") and also write a
slogan on the topic given by STAR India.
10. The Short-listed Participant(s) shall answer the question(s)
asked in the Test and write a slogan on the topic given by STAR
India.
11. STAR India will choose one (1) winner out of the
Short-listed Participant(s) who in view of STAR India scored the
maximum points, collectively earned in the Test and by giving
the most interesting slogan on the topic given by STAR India
will be selected as the winner of the Activity ("Winner").
12. STAR India reserves the right to decide the Short- listed
Participant(s) and/or the Winner of the Activity and the
decision of STAR India in relation to the Activity shall be
final and binding upon the Participant(s) during the Period of
the Activity or any time later and no disputes in this regard
will be entertained.
13. The Winner will be announced by STAR India during the
closing ceremony of the Match.
14. The Participant(s), Short-listed Participant(s) and/or the
Winner shall not raise any dispute with regard to the Activity
including but not limited to the selection of the Winner etc.
15. The Winner will win a Chevrolet Aveo car of the model Aveo
1.4 LS Platinum metal of approximately worth Rs. 6,59,049/-
(rupees six lakhs fifty nine thousand forty nine only) ("Prize")
sponsored by STAR India.
16. By participating in the Activity, it shall be construed that
the Participant(s), Short-listed Participant(s), Winner has
waived his/her right to raise any dispute with regard to the
Activity and/or in any manner whatsoever in connection to the
Prize including the brand, quality, value, model etc. of the
Prize, as the case may be.
17. All and any incidental costs direct and/or indirect, in
relation to the Prize, shall be borne by the Winner(s) and in no
manner whatsoever shall STAR India, be responsible for the same.
18. STAR India reserve the right to at any time to withdraw the
Activity without giving any prior notice thereof.
General Rules
1. The Participant(s) should be citizens of India, residing in
India and above 18 years of age to qualify for the Activity.
2. The Participant(s) should not have criminal conviction or an
arrangement or a contract that prevents the Participant(s) from
participating in the Activity.
3. Proof of age is a must for the Participant(s) and must be
submitted STAR India (i.e., Birth Certificate, 10th Class
leaving Certificate/ School certificate/ passport/ an affidavit
signed by a magistrate).
4. The STAR India reserves all rights to make amendments to the
existing rules without prior notice or withdraw the Activity
without giving prior notice in connection thereto.
5. Non-conformance by any Participant(s) and/or the Winner of
the rules of this Activity will disqualify them from
participation or winning, immediately, as the case may be.
6. STAR India may in its sole discretion exclude a Participant(s),
Short-listed Participant(s)/ Winner from participation in the
Activity which may include without limitation (i) circumstances
which, in STAR India's view, renders the Participant(s),
Short-listed Participant(s) unfit to participate therein; (ii)
inability to produce documentation required by STAR India in
this rules and regulations and/or at any given point of the
time.
7. Neither STAR India nor its employees have given a guarantee
and/or warranty etc. regarding quality and/or durability of the
Prize. Neither STAR India nor its employees shall be responsible
for any reason whatsoever in connection thereto.
8. STAR India states that the model of the Prize displayed on
the Match Ground or in the Stadium, as the case may be, shall
not be same which the Winner will be entitled to win. For sake
of clarity, the Prize won by the Winner may not be the same as
displayed on the ground of the Stadium.
9. STAR India reserves the right to cancel the entry of the
Participant(s), Short-listed Participant(s) and/or the Winner
for any reason whatsoever. For avoidance of doubt, the
disqualified Participant(s), Short-listed Participant(s) and the
Winner agrees that all the intellectual property rights in and
to the Activity including but not limited to the slogans made by
them shall continue to vest with STAR India for worldwide and in
perpetuity, without any consideration payable to the
disqualified Participants/ Short-listed Participant(s)/ Winner.
10. STAR India may refuse or bar the Participant(s),
Short-listed Participant(s) from participating in the Activity
in the event of his fraud, dishonesty or non-entitlement to
participate in the Activity under this rules and regulations.
11. The Winner of the Activity agrees that he/she shall make
himself/herself available from time to time and co-operate with
STAR India and participate in any activity and/or campaign
("Promotional Activity") of any nature whatsoever without any
money payable to the Winner. Further, the Winner shall at no
point of time refuse or disagree to participate in any such
Promotional Activity for any reason whatsoever. The Winner
agrees that the footage of any nature with regard to the Winner
shall vest with STAR India, including but not limited to all
intellectual property rights and any other rights for worldwide
and in perpetuity.
12. STAR India shall have irrevocably rights to the Activity
and/or participation of the Participant(s), Short-listed
Participant(s)/Winner including all the activities of the
Participant(s), Short-listed Participant(s)/Winner during their
participation in the Activity including but not limited to being
filmed and/or recorded and/or broadcast on any of the channels
and/or the channels of STAR India., which STAR India may deem
fit. Further, the Participant(s), Short-listed Participant(s)/
Winner shall permit STAR India to use of the Short-listed
Participant(s)/Winner's name, likeness and private life to be
included in the subject matter of the Activity and any related
publicity, advertising, magazine material and/or otherwise.
Further STAR India shall have full right to the footage of any
nature in relation to this Activity and all such rights shall at
all times vest with STAR India, including but not limited to all
intellectual property rights, copyrights and any other rights,
in any and all media, worldwide and in perpetuity. It can be
arranged, re-arranged, added to other material without any
payments to Participant(s), Short-listed Participant(s)/Winner.
13. Notwithstanding, a Participant(s), Short-listed
Participant(s)/ Winner's participation in the Activity there is
no obligation on the part of STAR India to broadcast the
Activity in which he has taken part, or any or all of his
contribution recorded by STAR India.
14. The Winner cannot exchange the Prize for another item or
cash equivalent. If the Winner refuses to accept the Prize
awarded, STAR India shall be released from all obligations
towards the Winner in connection to the Prize won by the Winner.
Further, after forfeiting the Prize, STAR India shall be
entitled to select and declare another Winner, as it deems fit,
and award the Prize, to that Winner.
15. The Winner shall be solely responsible to collect the Prize.
The Winner agrees that he/she shall not hold STAR India and/or
its employees, responsible for delays in delivery due to
shortage of stocks from the suppliers of the Prize or damage
during transit or any problem in connection to the Prize. The
Winner further agrees that he/she shall not hold responsible
STAR India in the event, the Winner fails to take possession of
the Prize within thirty (30) days from the date of intimation to
the Winner to collect the Prize, for reasons whatsoever. In such
an event, the Winner's right to the Prize shall be forfeited.
Further, after forfeiting the Prize, STAR India shall be
entitled to select and declare another Winner, as it deems fit,
and award the Prize, to that Winner.
16. The Winner agrees to complete all the necessary formalities
in relation to the Prize and also covenants to submit the
necessary documents as may be required by STAR India in order
take the possession of the Prize. The Winner further agrees that
STAR India shall not be liable for any incidental cost of
delivery, etc of the Prize and all the costs of delivery,
transportation and taxes etc shall be solely borne by the
Winner.
16. Neither STAR India nor its employees have given a guarantee
regarding the quality, brand, model etc of the Prize and further
agree not to hold STAR India, or its employees, responsible with
regards thereof. It is clarified that STAR India shall not be
responsible for the brand, quality, value etc. in connection to
the Prize.
17. By participating in the Activity, it shall be deemed to be
construed that the Participant(s), Short-listed Participant(s)/
Winner has waived his/her right to dispute the value, quality,
brand, model of the Prize so awarded to the Winner upon winning
the Activity. If the Winner refuses to accept the Prize offered,
STAR India shall be released from all obligations towards the
Winner in connection to the Prize won by the Winner.
18. By participating in the Activity, it shall be construed that
the Participant(s), Short-listed Participant(s)/Winner has
agreed that the Participant(s), Short-listed Participant(s)/
Winner shall hold harmless STAR India, its employees, officers
or any other person in relation to any injury/damage/harm/loss
suffered by the Short-listed Participant(s)/Winner, in any
manner, whatsoever in connection with the Activity and that the
Participant(s), Short-listed Participant(s)/Winner has waived
all rights to file in person or through any family member or
third party any applications, criminal and/or civil proceedings
in any courts or forum in India against STAR India to claim any
damages or relief's or otherwise.
19. By participating in the Activity, it shall be construed that
the Winner of the Activity has agreed that the Winner shall, at
all times, hold harmless STAR India, its employees, officers or
any other person in relation to any injury/damage/harm/loss
suffered by him/her in any manner, whatsoever, in connection
with the Prize and that the Winner shall also not file in person
and/or through any family member and/or third party any
applications, criminal and/or civil proceedings in any courts or
forum in India against STAR India to claim any damages or
relief's or otherwise.
20. The Winner agrees that if due to any reason, whatsoever,
beyond the control of STAR India, the Prize and/or anything in
connection to the Prize and/or the enjoyment of the Prize
becomes ineffective or invalid, STAR India cannot be held
responsible for the same.
21. STAR India is in no manner whatsoever responsible and/or
shall not be held liable in any manner whatsoever, for any
injury, death, mental trauma caused to the Winner in any manner
whatsoever or for any reason whatsoever in connection to the
Activity and/or Prize.
22. Any and all taxes and/or levies applicable under the laws of
India shall be borne by the Winner in relation to the Prize.
23. In the event, the Winner is required to pay withholding tax
and/or tax deductible at source under the Income Tax Act, 1961
under the laws of India in relation to the Prize, the Winner
shall furnish a copy of the receipt (challan) in relation to the
withholding tax and/or tax deductible at source paid by the
Winner.
24. Employees of STAR India, and the members of their immediate
family, persons with criminal convictions, persons other than
citizens of India, are ineligible to participate in the
Activity.
25. Participation of the Participant(s), Short-listed
Participant(s)/Winner in the Activity shall be construed that
the Short-listed Participant(s)/Winner has waived his/her right
to dispute any decision(s) made by STAR India in connection to
the Activity and that the Short-listed Participant(s)/ Winner
agrees to all the decision(s) made by STAR India and all such
decision shall be final and binding upon them.
26. STAR India reserve the right to forfeit the Prize in the
event it is found by STAR India that any information provided by
the Winner is wrong or any misrepresentation is made by the
Winner. STAR India shall have the right to declare another
Winner of the Activity and transfer the Prize to that person.
27. All the Short-listed Participant(s)/Winner shall do any and
all acts and execute any and all documents in such manner and at
such location as may be required by STAR India in its sole
discretion to protect, perfect or enforce any of the rights
granted or confirmed to STAR India.
28. The participation of the Participant(s), Short-listed
Participant(s)/Winner in the Activity shall mean that the
Short-listed Participant(s)/ Winner has read, understood,
accepted and agrees to abide with all the rules including the
general rules of the Activity.
29. The Participant(s), Short-listed Participant(s)/ Winner
shall comply with the laws of India.
30. The terms of this rules and regulations shall be construed
in accordance with the laws of India and incase of any dispute
or other matter arising in reference to this Activity shall be
referred to a sole arbitrator appointed by STAR India and shall
be governed by the Arbitration and Conciliation Act, 1996,
amended from time to time. The venue for arbitration shall be
Mumbai, in English language. All the costs, charges and expenses
in connection to the Arbitration shall be solely borne by the
person who has raised the dispute.
31. Subject to rule 30, only the courts in Mumbai shall have the
sole and exclusive jurisdiction to decide on any dispute
relating to this Activity.
